Terms of Service

1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you”, “your”, or “User”) and Cinematic Autobiography (“we”, “us”, “our”, or the “Company”) governing your access to and use of our website, mobile applications, and all related services (collectively, the “Service”).
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must not use the Service.
You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms.
2. Service Description
Cinematic Autobiography is a platform that helps users preserve family stories through documentary-style films. The Service includes:
- Interview recording: Tools for recording audio and video interviews on your device, guided by a curated library of interview questions.
- AI-powered processing: Automated transcription, audio enhancement, narrative extraction, photo animation, music scoring, and video assembly powered by artificial intelligence.
- Documentary creation: Assembly of your interviews, photos, and AI-generated elements into cinema-quality documentary films.
- Family tree management: Tools for building and visualizing your family tree with biographical data and photographs.
- Streaming and delivery: 4K streaming of your completed documentaries accessible through the Service.
- Partner network: Access to professional studios and filmmakers for premium documentary production services.
The specific features and capabilities available to you depend on your subscription plan or purchases. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.
3. Account Registration and Security
To use most features of the Service, you must create an account. When creating your account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized access or use of your account
You may not create an account using false or misleading information, create multiple accounts for abusive purposes, or use another person’s account without their permission. We reserve the right to suspend or terminate accounts that violate these requirements.
4. Subscriptions, Purchases, and Billing
4.1 Subscription Plans
The Service offers both one-time purchases and recurring subscription plans. Subscription details, including pricing, features, and billing frequency, are presented at the time of purchase and on our pricing page.
4.2 Auto-Renewal
Recurring subscriptions automatically renew at the end of each billing cycle (monthly or annually, as selected) unless you cancel before the renewal date. You will be charged the then-current subscription price at each renewal. We will notify you of any price changes at least 30 days before they take effect.
4.3 Billing
All payments are processed securely through Stripe. By providing payment information, you authorize us to charge the applicable fees to your chosen payment method. You are responsible for all taxes applicable to your purchases. Prices are displayed inclusive of VAT/sales tax where required by law.
4.4 Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation:
- Your subscription will remain active until the end of the current billing period
- You will not be charged for subsequent billing periods
- You will retain access to content created during your subscription
- No partial refunds are provided for unused portions of the current billing period, except as required by law
4.5 Free Trial
We may offer free trial periods for certain subscription plans. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial expires. We will remind you before the trial ends.
5. Refund Policy
5.1 EU Consumer Right of Withdrawal
If you are a consumer in the European Union or the European Economic Area, you have a 14-day right of withdrawal (cooling-off period) starting from the date of purchase, as provided under the EU Consumer Rights Directive (2011/83/EU). During this period, you may cancel your purchase for any reason and receive a full refund.
To exercise this right, send a clear statement of your decision to withdraw to support@cinematicautobiography.com. Refunds will be processed within 14 days of receiving your withdrawal notice, using the same payment method used for the original purchase.
If you have expressly consented to begin receiving digital content during the withdrawal period and acknowledged that you thereby lose your right of withdrawal, the cooling-off period may not apply to that specific content.
5.2 General Refund Policy
Outside of the EU cooling-off period, refund requests are handled on a case-by-case basis. We may issue refunds in the following circumstances:
- Technical failures that prevent delivery of the Service and cannot be resolved
- Duplicate charges resulting from billing errors
- Service not substantially as described at the time of purchase
To request a refund, contact support@cinematicautobiography.com within 30 days of the charge. Please include your account email and the reason for your request.
5.3 Apple App Store and Google Play Purchases
Purchases made through the Apple App Store or Google Play Store are subject to the refund policies of the respective platform. To request a refund for an in-app purchase, please contact Apple or Google directly through their standard refund process.
6. Content Ownership and Licensing
6.1 Your Content
You retain full ownership of all content you upload, record, or create through the Service, including but not limited to interview recordings, photographs, family tree data, and biographical information (“Your Content”). We do not claim ownership of Your Content.
6.2 License to Us
By uploading or creating content through the Service, you grant Cinematic Autobiography a non-exclusive, revocable, worldwide license to use, process, store, and display Your Content solely for the purpose of providing, improving, and delivering the Service to you. This license includes:
- Processing recordings through our AI pipeline (transcription, enhancement, assembly)
- Storing content on our infrastructure and third-party processors
- Streaming your completed documentary films to authorized viewers
- Creating thumbnails and previews for your media library
This license terminates when you delete Your Content or close your account, except to the extent we are required to retain data by law. We will never use Your Content for advertising, training AI models, or any purpose unrelated to delivering the Service to you.
6.3 Our Content
The Service, including its design, code, features, trademarks, logos, and all other intellectual property (“Our Content”), is owned by or licensed to Cinematic Autobiography and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works of Our Content without our prior written consent.
6.4 Music and AI-Generated Elements
Music tracks and AI-generated elements included in your documentary are licensed for personal, non-commercial use as part of the Service. Commercial use of these elements requires a separate license. Your original recordings and photographs remain entirely your property regardless of how they are incorporated into the final documentary.
7. Family Groups and Shared Data
7.1 Family Groups
The Service allows you to create or join family groups to collaborate on family stories and documentaries. When you add family members to your group, they may have access to shared content within that group, subject to permissions you configure.
7.2 Family Creator Responsibilities
If you are the creator of a family group, you are responsible for managing group membership and permissions. You should only invite individuals who have a legitimate connection to the family stories being preserved.
7.3 Account Deletion and Family Data
When a family group creator deletes their account, it may affect family-scoped data accessible to other family members. In this case:
- All family members will be notified immediately upon the deletion request
- A 30-day grace period applies during which the account and all data remain intact
- During the grace period, family members may download their own contributed content
- Another family member may be designated as the new group creator to preserve continuity
- If no new creator is designated within 30 days, shared family data will be permanently deleted
- Individual content contributed by other family members remains accessible in their own accounts
8. Acceptable Use Policy
You agree not to use the Service to:
- Upload, share, or create content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity
- Upload content that infringes on the intellectual property rights, privacy rights, or other rights of any third party
- Upload content depicting or promoting violence, exploitation, or abuse of any kind
- Use the Service for any commercial purpose not expressly authorized by us
- Attempt to gain unauthorized access to the Service, other users’ accounts, or our systems
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
- Introduce viruses, malware, or other harmful code into the Service
- Use automated tools (bots, scrapers, crawlers) to access the Service without our prior written consent
- Circumvent any technical measures we use to provide or protect the Service
- Misuse the AI processing features to generate content unrelated to legitimate family storytelling
- Use the Service in any way that violates applicable local, national, or international law
We reserve the right to remove content and suspend or terminate accounts that violate this Acceptable Use Policy, with or without prior notice, depending on the severity of the violation.
9. Account Suspension and Termination
9.1 Termination by You
You may delete your account at any time through your account settings or by contacting us at support@cinematicautobiography.com. Upon deletion, your data will be handled in accordance with our Privacy Policy.
9.2 Termination or Suspension by Us
We may suspend or terminate your account and access to the Service if:
- You violate these Terms or our Acceptable Use Policy
- Your account shows signs of fraudulent activity
- You fail to pay applicable fees after reasonable notice
- We are required to do so by law or court order
- Your continued use poses a risk to the security or integrity of the Service or other users
Where possible, we will provide notice before suspension or termination and give you an opportunity to remedy the violation. In cases of severe violations or imminent harm, we may act immediately.
9.3 Effect of Termination
Upon termination of your account:
- Your right to access the Service will cease immediately
- Any outstanding fees become immediately due
- Your data will be retained and deleted in accordance with our Privacy Policy
- Sections of these Terms that by their nature should survive termination will continue in effect (including Sections 6, 10, 11, 12, 13, and 14)
10. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Without limiting the foregoing, we do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- The results of AI processing (transcription, enhancement, assembly) will be accurate or meet your expectations
- Any defects in the Service will be corrected within a specific timeframe
- The Service will be compatible with all devices and operating systems
This disclaimer does not affect your statutory rights as a consumer under applicable law, including but not limited to EU consumer protection regulations. Nothing in these Terms is intended to limit rights that cannot be excluded or limited under applicable law.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CINEMATIC AUTOBIOGRAPHY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to, use of, or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
- Loss or corruption of your uploaded content, recordings, or documentary files
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
This limitation applies regardless of the legal theory on which the claim is based, whether in contract, tort (including negligence), strict liability, or otherwise, and even if we have been advised of the possibility of such damages.
Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.
12. Indemnification
You agree to defend, indemnify, and hold harmless Cinematic Autobiography and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property or privacy rights
- Content you upload or create through the Service
This indemnification obligation does not apply to the extent prohibited by applicable consumer protection law.
13. Copyright and DMCA
We respect intellectual property rights and expect our users to do the same. If you believe that content on the Service infringes your copyright, please send a notice to our designated copyright agent containing:
- A description of the copyrighted work you claim has been infringed
- A description of where the allegedly infringing material is located on the Service
- Your contact information (name, address, telephone number, email)
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf
- Your physical or electronic signature

We will investigate notices of alleged infringement and take appropriate action under the Digital Millennium Copyright Act (DMCA) and applicable international copyright laws, including removing or disabling access to infringing material and terminating repeat infringers.
14. Dispute Resolution
14.1 Informal Resolution
Before initiating formal dispute resolution, you agree to first contact us at support@cinematicautobiography.com and attempt to resolve the dispute informally for at least 30 days. Most concerns can be resolved quickly through direct communication.
14.2 Mediation
If the dispute cannot be resolved informally, either party may initiate mediation through a mutually agreed-upon mediator. The costs of mediation will be shared equally between the parties.
14.3 Arbitration or Litigation
If mediation fails, disputes may be resolved through binding arbitration or in the courts of competent jurisdiction. [Specific jurisdiction to be determined by legal counsel.]
14.4 EU Consumer Dispute Resolution
If you are a consumer in the EU, you may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr. This does not affect your right to bring proceedings in the courts of the EU member state in which you reside, as provided by applicable consumer protection law.
14.5 Class Action Waiver
To the extent permitted by law, you agree that any disputes will be resolved on an individual basis and not as part of a class, consolidated, or representative action. This waiver does not apply where prohibited by applicable law.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [jurisdiction to be determined by legal counsel], without regard to its conflict of law provisions.
If you are a consumer in the EU, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions.
16. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation, facilities, fuel, energy, labor, or materials, or failures of telecommunications or information systems.
17. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
18. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Cinematic Autobiography regarding the Service and supersede all prior agreements, representations, and understandings.
19. Changes to These Terms
We may modify these Terms from time to time. When we make material changes, we will:
- Provide at least 30 days’ notice before the changes take effect
- Notify you via email or a prominent notice within the Service
- Update the “Last updated” date at the top of this page
Your continued use of the Service after the 30-day notice period constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and may cancel your account.
For changes required by law or regulation, or changes that do not materially affect your rights, the 30-day notice period may not apply.
